These Terms of Use ("Terms") are an agreement between you and Nature's Remedy LLC, doing business as Nature's Remedy, and its affiliated retail locations in Ferndale, Redford and Pontiac, Michigan ("Nature's Remedy," "we," "us," or "our"). They govern your use of https://www.naturesremedycannabis.com (the "Site") and the services offered through it, including browsing products and educational content, booking appointments, and placing orders for in-store pickup (together, the "Service"). "You" means any person who accesses or uses the Service.

Nature's Remedy is a licensed adult-use cannabis retailer regulated by the Michigan Cannabis Regulatory Agency (License No. 1104933740).

1. Acceptance of Terms

By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Privacy Policy

Our Privacy Policy explains how we collect, use and share your information. It is part of these Terms.

3. The Service

The Service lets you view our menu, product information and educational material, book appointments, and reserve products for pickup at any of our stores. Product listings are for information only and are not an offer to sell to anyone who is not legally eligible to buy.

4. Eligibility and Age Verification

  • You must be 21 or older to access the Site, use the Service, or buy cannabis from us.
  • Before entering the Site, you must complete our age verification and confirm that you are 21 or older. Giving false information to pass age verification is a violation of these Terms.
  • Every purchase requires a valid, unexpired government-issued photo ID at pickup, and the name on the ID must match the order.
  • We may refuse service to anyone who cannot verify their age or identity, appears intoxicated, or is attempting a purchase for someone under 21.
  • Products are sold for personal use only and may be bought, possessed and used only as permitted by Michigan law.

5. Accounts

If you create an account, you agree to provide accurate information, keep it current, and keep your password confidential. You are responsible for all activity under your account. Notify us right away through the contact form on our Site if you suspect unauthorized use. Accounts are limited to one per person and may not be shared or transferred.

6. Cannabis Disclosures and Health Information

  • Federal law. Cannabis remains a controlled substance under U.S. federal law. Using, possessing or transporting it may carry federal legal risk even where state law permits it.
  • Stay in Michigan. It is illegal to take cannabis products across state lines or to resell them.
  • Not medical advice. Content on the Service, including staff recommendations and educational material, is for general information only. It is not medical advice and is not a substitute for advice from a licensed healthcare provider. These products have not been evaluated or approved by the U.S. Food and Drug Administration to diagnose, treat, cure or prevent any disease.
  • Health warnings. Cannabis can impair concentration, coordination and judgment. Do not drive or operate machinery after use. Do not use if pregnant or breastfeeding. Keep out of reach of children and pets. The effects of edibles may be delayed by up to two hours. Consult a doctor before use if you have a medical condition or take medication.
  • Product information. We work to keep product details, potency and lab results accurate, but much of this information comes from manufacturers and testing labs. Actual products and effects may vary.

7. Orders, Pricing and Pickup

  • Reservations, not sales. An online order reserves products for pickup. The sale is completed in store after ID verification and payment, unless we tell you otherwise at checkout.
  • Purchase limits. Orders are subject to the purchase limits set by Michigan law. We may adjust or cancel orders that exceed them.
  • Pricing and availability. Prices, promotions, taxes and inventory can change without notice. Images are for illustration only. If an item is listed at an incorrect price or is out of stock, we may cancel or adjust that item.
  • Pickup. Orders must be picked up by the person who placed them, during posted store hours, within the window shown at checkout. Unclaimed orders may be cancelled and returned to inventory.
  • Right to refuse. We may refuse or cancel any order, including orders involving suspected fraud or resale, or orders we believe would violate the law.
  • Returns. Because cannabis is a regulated product, sales are generally final. Concerns about defective products are handled as Michigan regulations allow; please contact us within the time stated in our in-store policy.

8. Third-Party Ordering Platforms and Links

Our online menu and ordering may be powered by third-party providers such as Dutchie. When you use those tools, their own terms and privacy policies also apply. The Service may also link to other websites. We do not control third-party sites or services and are not responsible for their content, availability or practices. You use them at your own risk.

9. Acceptable Use

You agree not to:

  • Use the Service for anything other than personal, non-commercial use;
  • Buy or attempt to buy products for resale or for anyone who is not legally eligible;
  • Provide false information, including false age or identity information;
  • Use another person's account or allow someone else to use yours;
  • Collect or harvest other users' personal information;
  • Use bots, scrapers, crawlers or other automated tools, or bypass robots.txt or other access controls (public search engines may index the Site for search purposes only);
  • Interfere with, overload, or attempt to gain unauthorized access to the Service or its security features;
  • Upload or link to viruses or other malicious code;
  • Harass, threaten or abuse anyone; or
  • Use the Service for any unlawful purpose.

10. User Content

Information you submit, such as account details, reviews or messages ("User Content"), remains yours. You grant us a non-exclusive, royalty-free, worldwide license to use, store, display and reproduce it as needed to operate, improve and promote the Service. You confirm that you have the right to submit it and that it is accurate, lawful and not offensive. We may remove any User Content at our discretion. We do not pre-screen all User Content and are not responsible for content posted by others.

11. Intellectual Property

The Service and its content, including text, graphics, logos and software, belong to Nature's Remedy or its licensors and are protected by law. You may view the Service for personal use only. You may not copy, distribute, modify or create derivative works from it without our written permission. Other product and brand names belong to their respective owners.

12. Text Messages and Email

You agree that we may send you communications electronically, and that these satisfy any legal requirement for written notice. If you opt in to text messages, you agree to receive recurring automated order updates and marketing texts at the number you provide. Consent is not required to make a purchase. Message and data rates may apply; message frequency varies. Reply STOP to unsubscribe or HELP for help. You can opt out of marketing email using the "Unsubscribe" link in any message or by reaching us through the contact form on our Site. Opting out of marketing does not stop order-related messages. Emails sent through the Service do not constitute legal notice to us.

13. Copyright Complaints (DMCA)

We respect intellectual property rights and will terminate repeat infringers in appropriate circumstances. If you believe content on the Service infringes your copyright, send a notice under 17 U.S.C. § 512 to our designated agent:

Designated Copyright Agent: Antonio Bashlor
Nature's Remedy LLC, 925 E Drayton St, Ferndale, MI 48220
contact us through our contact form

Your notice must include: (1) your physical or electronic signature; (2) identification of the copyrighted work claimed to be infringed; (3) identification of the allegedly infringing material and its location on the Service; (4) your contact information; (5) a statement of your good-faith belief that the use is not authorized; and (6) a statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

If your content was removed and you believe this was a mistake, you may send a counter-notice that includes your signature; a description of the removed content and where it appeared; a statement under penalty of perjury that you have a good-faith belief the content was removed by mistake or misidentification; your name, address, phone number and email; and your consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, the U.S. District Court for the Eastern District of Michigan). We may restore the content within 10 to 14 business days unless the original complainant files a court action.

14. Termination

We may suspend or end your access to the Service at any time, without notice, if we believe you have violated these Terms or the law. Provisions that by their nature should survive termination will survive.

15. Disclaimer of Warranties

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, accuracy and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free. Some jurisdictions do not allow these disclaimers, so they may not apply to you.

16. Limitation of Liability

To the fullest extent permitted by law, Nature's Remedy and its affiliates, officers, employees, agents and licensors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or use, arising from your use of or inability to use the Service, any User Content, or any third-party service, under any legal theory. Our total liability for any claim relating to the Service will not exceed the greater of $100 or the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, including the Michigan Consumer Protection Act.

If you are a California resident, you waive California Civil Code § 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."

17. Indemnification

You agree to defend, indemnify and hold harmless Nature's Remedy and its affiliates, officers, employees and agents from any claims, losses, damages and expenses, including reasonable attorneys' fees, arising from your violation of these Terms, your misuse of the Service, your User Content, or your violation of any law or third-party right.

18. Governing Law and Venue

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-law rules. Any dispute will be brought exclusively in the state courts of Oakland County, Michigan, or the U.S. District Court for the Eastern District of Michigan, and you consent to the jurisdiction of those courts.

19. Time Limit for Claims

To the extent permitted by law, any claim arising from these Terms or the Service must be filed within one (1) year after it arises, or it is permanently barred.

20. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on the Site and revise the Effective Date above, and we will make reasonable efforts to notify you of material changes by email or by a notice on the Site. Your continued use of the Service after changes take effect means you accept them.

21. Accessibility

We want the Service to be usable by everyone. If you have difficulty accessing any part of it, reach us through the contact form on our Site and we will help.

22. General Terms

These Terms and our Privacy Policy are the entire agreement between you and us regarding the Service and replace any earlier agreements. If any provision is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will stay in effect. Our failure to enforce any provision is not a waiver. We may assign these Terms; you may not assign them without our written consent. Any waiver or amendment must be in writing and signed by an authorized officer of Nature's Remedy LLC.
